1. NOTICE & ACCEPTANCE

These Terms & Conditions (“Terms”) are a legally binding agreement between you (“You” or “Your”) and Root Alchemist LLC, doing business as Rooted Trichology Collective (“Company,” “We,” “Us,” or “Our”). By accessing or using Our website, submitting cases, enrolling in memberships or programs, or otherwise using Our services, You agree to these Terms. If You do not agree, please do not use or access Our services.

2. WHO WE ARE & WHAT WE OFFER

Rooted Trichology Collective is a professional peer-review, protocol support, and coaching service for trichologists and stylists transitioning into trichology. Our services include (but are not limited to):

• Single case peer reviews (Single Case Support)

• Unlimited case submission under membership (Collective Membership)

• Coaching and mentorship programs

• Educational content, protocols, templates, and related resources

These Terms govern all offerings on Our site or through Our service platform.

3. ELIGIBILITY & USER REQUIREMENTS

• You must be at least 18 years old (or of legal age in Your jurisdiction) to use Our services.

• You affirm that You have all necessary rights, consents, and permissions to provide the information you submit, including client cases.

• You agree not to use Our services in violation of any law or regulation.

4. CLIENT DATA, CONFIDENTIALITY & CONSENT

• When submitting a client case, You confirm that you have obtained necessary permission from the client to share their personal, non-identifiable data for peer review.

• You are responsible for de-identifying sensitive personal information where required by law or ethics.

• While We treat submitted information with professional care, we cannot guarantee absolute confidentiality, especially in collaborative or peer group settings.

5. INTELLECTUAL PROPERTY

• All content, materials, protocols, guides, templates, graphics, and training resources provided by Us are protected intellectual property owned by Root Alchemist LLC, unless otherwise noted.

• You are granted a limited, non-transferable, non-exclusive license to use materials for your personal professional practice only.

• You may not share, reproduce, distribute, republish, or make derivative works of materials without explicit written permission from Us.

6. DISCLAIMERS & LIMITATIONS

• We are not medical professionals. All recommendations, protocols, or insights are for professional, educational, and collaborative purposes only.

• You remain fully responsible for all clinical decisions, client interactions, and outcomes.

• Our liability is limited; we are not responsible for actions taken based on our suggestions or for adverse results in client care.

• We are not liable for omitted or withheld case data that may affect outcomes.

7. ASSUMPTION OF RISK

By using Our services, You assume all risk associated with applying the insights, protocols, or guidance provided. You acknowledge that outcomes may vary due to individual client factors, completeness of case information, and external variables beyond Our control.

8. PRICING, PAYMENT & REFUNDS

• Single Case Support: Payment is collected at time of submission. Once the case review is initiated, no refund is available.

• Membership / Collective Membership: Billed monthly until canceled. You may cancel anytime, but will not receive a prorated refund for the current billing cycle.

• Coaching or specialty programs: Refund policies may be defined in program-specific contracts or agreements.

We reserve the right to modify pricing, offerings, or payment terms, but will notify You of material changes.

9. ACCOUNT TERMINATION & SUSPENSION

We may suspend or terminate Your access to services, membership, or accounts at Our sole discretion (e.g., for misconduct, violation of Terms, or misuse).
You may cancel or terminate services by contacting Us per the cancellation instructions. Termination does not relieve You of any outstanding financial obligations.

10. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Root Alchemist LLC, its officers, employees, partners, and affiliates from and against any claims, liabilities, damages, losses, or expenses (including legal fees) arising out of:

• Your use of Our services

• Your violation of these Terms

• Your clinical decisions or client outcomes

• Your breach of intellectual property or confidentiality obligations

11. LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, Our liability to You for any claim arising under these Terms shall not exceed the total amount You paid for the relevant service or membership. We will not be liable for indirect, incidental, special, consequential, or exemplary damages (loss of profits, goodwill, data, etc.), even if We have been advised of the possibility of such damages.

12. MODIFICATIONS TO TERMS

We may update or modify these Terms at any time. When changes are material, We will notify You via email or site notice. Your continued use of Our services after such changes will constitute acceptance of the new Terms.

13. GOVERNING LAW & DISPUTE RESOLUTION

These Terms shall be governed by the laws of the State of Wisconsin, without regard to conflict of laws principles.
You agree that any dispute will be resolved in the courts of Waukesha County, Wisconsin. Prior to litigation, both parties will attempt good-faith negotiation or mediation.

14. SEVERABILITY

If any portion of these Terms is found unenforceable, that portion will be severed, and the remaining provisions remain in full force.

15. ENTIRE AGREEMENT

These Terms, together with any additional policies (e.g. Privacy Policy) and service-specific agreements, constitute the entire agreement between You and Root Alchemist LLC regarding Rooted Trichology Collective.
